Notice of Sale of Personal Property for Delinquent Tax
By virtue of Notice of Distraint issued by the Department of Finance, State of Washington, pursuant to R.C.W. 84.56.070 and 84.56.090, governing the collection of delinquent personal property taxes, notice is hereby given that I, Gary Robinson, Director of Pierce County Finance Department, have distrained and take possession of the following described personal property, to-wit:

being the property of Dragon Gate Oregon LLC, DBA Sushi Mioga (former known as Sushi Express), owner or reputed owner thereof, upon which is due personal property tax and interest for the years 2018, 2019, and Advance 2020 amounting to One Thousand Seven Hundred Nine Dollars & Sixty-Four 100s ($1,709.64) and that I will proceed to sell the above described property via online auction through Ehli Auctions at www.cyberauctions.com, in Pierce County, Washington, starting at 10 o’clock a.m. on the 22nd day of August, 2019 and ending at 10 o’clock a.m. on the 27th day of August, 2019. Interest and Costs will accrue at the Statutory Rate. Tax Parcel # 1200166342.

SALE IN ACCORDANCE WITH R.C.W. 84.56.070 & 84.56.090
This sale is pursuant to authority contained in R.C.W. 84.56.070 & 36.16.145 and by virtue of the Personal Property Tax Distraint of the Pierce County Finance Department. Notice of this sale has been given in accordance with the requirements of law.
You must be at least 18 years old to register and participate in the auction.
Items are sold subject to Federal Tax Liens, if any, and any other liens as may be announced when the items are up for bid.
The auction will sell without reserve to the highest and capable bidder.
The items (personal property) will be sold “as is, where is” with no warranties, either expressed or implied, except as provided herein or by law.
The auction will be conducted by Ehli Auctions Company (www.ehliauctions.com), 253-572-0990. The auction will be held via an on-line auction at www.cyberauctions.com. The auction will begin on August 22, 2019 starting at 10:00 AM (PT) and will close on August 27, 2019 at 10:00 AM (PT).
Successful bidders must arrange with Auctioneer to pick up items. Items will need to be picked up at Ehli Auctions the day following the close of the auction. Address is 9415 Pacific Ave, Tacoma, WA 98444.
If a bidder refuses to pay for an auctioned item prior to removal of the item from the auction site, Auctioneer may, at its option, return the item in question to Seller. Seller will pay auctioneer a selling commission of 30% of the gross amount for which the property is sold, exclusive of sales tax and buyer’s premium in addition to a $150.00 Pre-auction Estimate Fee. Auctioneer is entitled to charge and keep as an additional commission, a 15% buyer’s premium that Auctioneer will add to the amount of the highest bid for each item sold and collect from the respective buyers.

The Pierce County Finance Department will hold any proceeds from any sale in excess of the tax, distraint costs, fees, interest, and penalties for the owner, or his legal representative, subject to the County’s right to interplead said proceeds upon the presentation of conflicting claims or right, including claims of creditors.
Terms of sales are subject to modification prior to the commencement of the sale.
By submitting a bid, you agree to the terms of sale as posted at the time bid is submitted.
All sales are final. There are absolutely no refunds.

Bidders are required to conduct any research of due diligence they wish to conduct prior to submitting bid. Prior to placing a bid, bidders should review the attached information from the Forest Service. Bidders should contact Brian Lee with the Forest Service at 425-888-8795, bflee@fs.fed.us to inquire about applying for a special use permit, Forest Service Requirements, and application, annual, and transfer fees as amounts are subject to change.
